Terms of Service
These terms apply when you access and use Pettrait's pet portrait generation service. By using Pettrait, you agree to these terms.
Service Description
Pettrait provides tools for generating original pet portraits, movie poster-style works, fashion magazine cover-style works, and related creative outputs based on uploaded photos. Results may vary depending on image quality, pet type, style choices, and model availability. Pettrait does not guarantee that every generation will produce satisfactory results, and makes no warranty regarding the accuracy, quality, or appropriateness of generated content for any specific purpose.
Eligibility and Account
You must be at least 18 years old to use Pettrait. If you are between 13 and 18, you must have parental or guardian consent. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
User Content and Responsibilities
You retain all rights to the photos you upload. You represent and warrant that you own or have obtained all necessary rights, licenses, and consents to upload your content and to grant the rights described in these terms. You may not upload illegal, infringing, harassing, defamatory, obscene, sexually explicit, violent, hateful, discriminatory, or otherwise inappropriate content. You may not upload content that violates any applicable law or infringes any third-party rights, including copyright, trademark, privacy, or publicity rights.
Generated Content and Intellectual Property
Pettrait-generated works may be used and shared for personal, non-commercial purposes. Commercial use, advertising, redistribution at scale, or sublicensing of generated works may require separate written agreement. You acknowledge that generated content is created algorithmically and may unintentionally resemble existing works. Pettrait does not claim ownership over generated outputs. You are solely responsible for evaluating whether your use of generated content complies with applicable laws and third-party rights.
Payments and Credits
Some features require credits, which may be purchased through available payment providers. Credit prices, package options, and usage rates are displayed before purchase and are subject to change. Credits are non-refundable except as expressly stated in the Refund Policy. If a generation fails due to a system error, deducted credits will be returned automatically. Credits have no monetary value and are not exchangeable for cash. Pettrait reserves the right to adjust, suspend, or terminate credit balances in cases of fraud, abuse, or violation of these terms.
Prohibited Conduct
You agree not to: (a) use Pettrait for any unlawful purpose or in violation of any applicable law; (b) upload content that infringes any third-party rights; (c) attempt to bypass rate limits, access controls, or payment requirements; (d) scrape, crawl, or harvest any data from Pettrait at scale; (e) resell, sublicense, or redistribute generation capacity or generated works without authorization; (f) reverse-engineer, decompile, or tamper with the service; (g) use Pettrait to create content that is defamatory, harassing, hateful, violent, or sexually explicit; (h) impersonate any person or entity; or (i) interfere with the proper functioning of the service.
AI-Generated Content Disclaimer
Pettrait uses generative artificial intelligence models to create works based on user inputs. Generated results are not manually reviewed before delivery. You acknowledge that: (a) generated content may contain visual artifacts, inaccuracies, or unintended elements; (b) AI models may produce varying results from the same inputs; (c) the system may not accurately render text, faces, pet features, or fine details; (d) generated works should not be relied upon for any professional, medical, legal, or safety-critical purpose. Pettrait makes no representation or warranty regarding the originality, accuracy, completeness, or legal non-infringement of generated content.
Movie Poster and Magazine Cover Styles
Movie poster and magazine cover styles use fictional titles, fictional critic quotes, fictional awards, fictional credits, fictional mastheads, and original layouts. These elements are generated algorithmically and are not based on real films, real magazines, real brands, real people, or real events. The system does not provide a service for replicating specific existing works. Users may not request content that infringes third-party intellectual property or trademarks.
Limitation of Liability
To the maximum extent permitted by applicable law, Pettrait and its operator NCREATE PTE. LTD. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the service. Our total liability for any claim arising from or related to these terms shall not exceed the total amount you have paid to Pettrait in the six months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.
Indemnification
You agree to indemnify, defend, and hold harmless NCREATE PTE. LTD., its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from or related to: (a) your use of Pettrait; (b) your uploaded content; (c) your violation of these terms; (d) your violation of any applicable law or third-party rights; or (e) your generated content and how you use, share, or distribute it.
Termination
Pettrait reserves the right to suspend or terminate your access to the service at any time, without notice, for conduct that violates these terms, applicable law, or that is harmful to other users, third parties, or the service itself. Upon termination, your right to access the service will immediately cease. Sections regarding indemnification, limitation of liability, intellectual property, and governing law shall survive termination.
Service Changes and Availability
Pettrait may update, modify, suspend, or discontinue any feature, price, credit rule, or aspect of the service at any time for product, technical, compliance, or business reasons. Pettrait does not guarantee uninterrupted or error-free operation of the service. The service may be temporarily unavailable for maintenance, upgrades, or due to factors beyond our control.
Pettrait Paws Fund
Pettrait may contribute a percentage of eligible paid orders to animal welfare initiatives. This is a company giving initiative by NCREATE PTE. LTD., not a user-directed donation. Users do not receive tax deductions from this initiative. Partner organisations and contribution schedules may change over time.
Governing Law and Dispute Resolution
These terms are governed by the laws of Singapore, without regard to its conflict of laws principles. Any dispute arising from these terms or your use of Pettrait shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, it shall be finally settled by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (SIAC) by a single arbitrator. The arbitration shall be conducted in English. You agree that any claim must be brought within one year after the cause of action arises.
